The Servicemembers Civil Relief Act is a law that protects active military personnel from losing their home to foreclosure. A loan servicer can only get a court order to foreclose on a home if the Servicemembers Civil Relief Act is followed. It will also lower the interest rate on their mortgage.

The Service Members Civil Relief Act is designed to help military service members who took out a mortgage before enlisting or being recalled to active duty. The program applies to all military branches, including the Navy, Army, Navy, Marine Corps, Coast Guard, and Air Force. Type of mortgage help is offered by the Service Members Civil Relief Act

This new federal government act will help to limit and reduce the interest rates on mortgages, making it more affordable for people looking to buy a home. If you request it, banks and mortgage lenders must lower the interest rate on your home loan to no more than six percent per year. This new interest rate will apply to active military service. The lender will need to recalculate your monthly mortgage payments to reflect the lower interest rate.

If you want to have your mortgage payments suspended while you are on active military duty, you need to send a written request to your bank or mortgage lender. You will also need to provide them with supporting documentation, like a copy of your military orders. You have a lot of time to tell your lender. The request can be submitted as soon as your military orders are ready. The notice should be sent to your lender as soon as possible after you are released from active duty military service, but no later than 180 days after the date of your release. You can send the letter even after you have finished your service.
